HYDERABAD: Stating that there is prima facie material in the case filed by the CBI against IRAS officer and AP special secretary KV Brahmananda Reddy in Vanpic chargesheet of the quid pro quo case, the Telangana high court has dismissed the criminal revision plea seeking his discharge from the case.
“The material on record may or may not lead to your conviction but that material is sufficient to conduct a trial and hence it may not be correct for a high court to abort the trial at this stage. This is a case that requires a trial, better go face it and argue your case before the trial court during the trial,” said Chief Justice Ujjal Bhuyan, who heard the plea filed by the IRAS officer against the CBI court order which had dismissed his discharge plea.
Senior counsel Vinod Kumar Deshpande, who argued Reddy’s case, explained to the court that Reddy came on deputation to serve AP’s infrastructure and investments department as a special secretary and that the CBI had unnecessarily made him an accused though he was not a competent authority and all decisions in Vanpic episode were taken by the state cabinet.
The judge referred to the chargesheet filed by the CBI that made Reddy accused No. 6 in the Vanpic case. It said that in furtherance of the criminal conspiracy, he intentionally withheld many crucial aspects from the council of ministers while processing the memorandum to be placed before the cabinet.
Though he knew the master plan of businessman Nimmagadda Prasad, who is accused No. 3 in the case, to acquire 28,000 acres for the project, he did not include this aspect in the cabinet memorandum prepared and presented before the cabinet on June 30, 2008, the CBI chargesheet said, adding that this was part of the criminal conspiracy he had hatched with other accused in the case.
The CJ dismissed the plea of the IRAS officer while expressing a view that the current case has adequate grounds to sustain a criminal trial.
