Telangana government planning to move HC against governor | Hyderabad News
HYDERABAD: Worried about the fast approaching deadlines in respect of presenting the annual budget to the state assembly and annoyed about the non arrival of the consent from the governor Tamilisai Soundararajan for the same, the Telangana government is now planning to move an urgent plea before the high court on Monday with a request to the court to direct the governor to forthwith approve the state budget.
Though the state government circulated the file to the governor’s office on Jan 21 itself, it received no approval or consent for the same till Sunday and as Feb 3, the proposed date for presenting budget, as fast approaching the state administration has reliably come to a conclusion that they have no other option other than moving the court.
Interestingly, the governor’s secretary wrote back to the state whether the state has arranged for the customary address of the governor to be made at the first session of the assembly, if so, a copy of the governor’s peech was sought for verification.
The state administration is of the view that both are entirely different issues and the governor can first convey the approval for the presentation of the budget in view of the urgency involved. There is no such provision in the constitution that asks the governor to compulsorily address the assembly session and it has got no relevance to the presentation of the state budget, the state officials say.
The state wants the court to remind the governot through her secretary on the need to act immediately as it may result in a constitutional crisis and defeat the mandate of constitutional provisions like Article 202 wherein the governor is under an obligation to present the annual financial statement or the budget before the assembly. The governor is bound to act on the aid and advice of the state cabinet under Article 163.
Though the Governor has got discretion in certain areas, but spheres like annual budgets accord no such discretion to the governor, state officials say. The state may move a lunch motion on Monday before the HC for this purpose.
