Jubilee Hills gang-rape: JJ Board grants bail to 4 minors, no relief for adult | Hyderabad News
HYDERABAD: After being under detention for 48 days, four minors allegedly involved in the Jubilee Hills gang-rape were granted bail by the Juvenile Justice Board on Tuesday. They were released from the juvenile home later in the evening. The fifth minor accused in the case – son of a legislator – was ordered to stay back in the home as he had earlier approached the Telangana high court for bail.
The only adult arrested in the case, Saduddin Malik, was also refused bail.
“We have received a bail order from the juvenile court and four children in conflict with law (CCLs) have been released on Tuesday evening,” confirmed Syed Afzal Shahli, superintendent of the juvenile home for boys at Saidabad, where the five were lodged.
Accused say they are entitled to bail
Sources said, appealing before the Juvenile Justice Board the counsels for the accused contended that the minors were entitled to bail as investigation into the case, including identification parade, recording of statement of the survivor under Section 164 of the CrPC before the magistrate, DNA test and forensic examination of the car used in the crime had all been completed by the Jubilee Hills police.
Though the prosecution filed a counter stating that the investigation was still underway and their release could prove detrimental to the proceedings, the board accepted the bail petition with some conditions.
It ordered the accused to cooperate with the investigating officers, record their attendance before the district probation officer (DPO), Hyderabad, every month and furnish two sureties of `5,000 each. On June 8, the Hyderabad police had announced the arrest of six accused, including five minors and an adult in the Jubilee Hills gang-rape case.
