HYDERABAD: Twenty-six All India Services (AIS) officers who were allotted to one state ended up in another state thanks to Pratyush Sinha Committee’s lapses committed during division of officers, alleged chief Secretary Somesh Kumar.
Stating that this had resulted in huge upheaval in the slots available for swapping, Kumar said that he remained a ‘solitary outsider’ in the 1989 batch of IAS officers due to the faulty and confusing guidelines prepared by the committee. Senior counsel DV Sitarama Murthy was arguing the case of Kumar before the high court bench of Justice Ujjal Bhuyan and Justice S Nanda which was hearing a batch of cases on cadre tussles.
Kumar was rendered ineligible to choose swap methods because there was none available in the unreserved outsider category for the 1989 batch of IAS officers, Murthy reasoned. For reserved categories, a roster band was created wherein the officers belonging to reserved communities could swap their places regardless of their year of recruitment, he said. “It is unfair on part of the committee to create so many categories within a uniform group,” he said.
Ironically, the then chief secretary PK Mohanty, who was made to relinquish a few days of his service with a design to subvert the process and options available to officers like Kumar, started claiming that he was not in service on the cut-off date (June 1, 2014), Murthy said.
“This is a blatant lie because the GO that announced the relinquishment of service by Mohanty and the additional charge of chief secretary given to the then CCLA IYR Krishna Rao was also given under the name of Mohanty on June 1, 2014,” he said, buttressing the point that Mohanty was very much in service on that day and hence his name should have been included in the list of officers.
The bench posted the case to June 7 for further hearing.
